smoothrp Posted January 8, 2017 Posted January 8, 2017 Maybe someone can enlighten me. I have allready send a email to Hyperspin en Nintendo but no answer from both. I have build a (genuine drive) Hyperspin arcade cabinet and retropie arcade cabinet. I'm thinking about selling them on order but dont want to get in trouble with copyrights and all. I have read on the Nintendo site that is ILLEGAL to distribute/sell/own Nintendo roms (even if you have the original, keep them for 1 hour, etc etc). They are the only one having copywrights for them. How does Hyperspin pull this off? They dont have license for them, i cant find it anywhere on there site. I have send 3 mails asking this because i want to buy some drives, they aswer my email regarding the sale, but not to my question if they have a license for the roms. So my question is: How can they sell and not get in trouble with Nintendo?
Agrajag Posted January 8, 2017 Posted January 8, 2017 There is no such thing as a genuine HyperSpin drive.This official HyperSpin website does not sell or distribute ROMs. Any sites, companies or individuals selling ready built HyperSpin drives or arcade machines with it installed are not affiliated with this site and are breaking both the law and the HyperSpin license terms.

So you are telling me if i would buy a 320$ 5tb harddrive from Hyperspin, not a single game is on it ? And if its illegal. Why does archives.org provide all the SNES and NES roms there is. And ebay is full of people who sell roms. Very strange. But im not gonna take my changes, if its not legal, i am not gonna do it. Dont want any trouble.

Anyone claiming to sell official HyperSpin drives is lying and you buy one at your own risk as they are not supported here.The reason why there are games on archive.org and drives on eBay is that the copywriter holders haven't bothered to put a stop to it.

rastan Posted January 8, 2017 Posted January 8, 2017 I'm thinking if you have to ask questions about this kind of stuff you shouldn't be thinking about it in the first place. it's like a drug dealer worrying about the legal issues of their business. if you own a cartridge or board it's yours.. do with it as you want.. even sell it... but you can't just copy/clone em and sell em like some mass production operation.. one of the reasons that the subject of where to get the goods is always hush hush and all the law breakers keep their mouth shut.

Nintendo has a strong legal team that handles copyright issues.... and just because some fly by night operations seem to fly under the radar doesn't mean they aren't breaking the law or that they aren't on the radar. nintendo isnt going to go after everybody selling drives with their games... but you wouldn't want to be that person that gets caught and made an example out of.
